BenchMark'd is operated by Berkay as an independent project ("we," "us," or "our"). These Terms constitute a legal agreement between you and us.
You must be at least 13 years of age to use the Service. By creating an account, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent's or guardian's consent to use the Service.
If we learn that a user is under 13, we will terminate their account and delete their data promptly.
To access most features of the Service, you need to create an account. You may register using an email address and password, or by authenticating through a supported OAuth provider (GitHub, Google, or Discord).
You are responsible for:
You may not create multiple accounts to circumvent bans, inflate ratings, or manipulate platform features.
You may delete your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms (see Section 10).
"Your Content" refers to any material you submit, post, or upload to the Service, including but not limited to:
You retain ownership of Your Content. We do not claim ownership of reviews, comments, or any other material you create on the Service.
By posting content on the Service, you grant BenchMark'd a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute Your Content solely for the purpose of operating and providing the Service. This includes:
This license ends when you delete Your Content or your account, except for content that has been shared by other users or cached by external services (which is outside our control).
You agree not to use the Service to:
We use a combination of automated and manual moderation to enforce our content policies:
Content that violates our policies may be removed without notice. We are not obligated to provide specific reasons for individual moderation decisions, but we aim to be fair and consistent.
The Service, including its design, code, branding, logos, and original content (excluding user-generated content), is the intellectual property of BenchMark'd. You may not copy, reproduce, or distribute any part of the Service without our written permission, except as permitted by applicable law.
Information about AI models displayed on the Service (names, descriptions, benchmark scores) is compiled from publicly available sources and may be subject to the intellectual property rights of the respective model creators. We make reasonable efforts to attribute information accurately but do not claim ownership of third-party model data.
If you believe content on the Service infringes your copyright, contact us at the address in Section 16 with a description of the copyrighted work, the location of the infringing content, and your contact information. We will investigate and take appropriate action.
The Service integrates with and depends on several third-party services, including:
Your use of these services through BenchMark'd is also subject to their respective terms of service and privacy policies. We are not responsible for the practices or availability of third-party services.
User-generated content may include links to external websites. We do not endorse or take responsibility for any third-party sites linked from the Service.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Reviews, ratings, and benchmark scores on the Service reflect the opinions and data contributions of individual users and public sources. We do not guarantee the accuracy, completeness, or reliability of any content on the platform. AI model evaluations are subjective and should not be the sole basis for any decision.
We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any part of the Service at any time without prior notice.
We may suspend or terminate your account if you:
Where possible, we will notify you of the reason for suspension or termination. Banned users are prevented from accessing authenticated features of the Service.
If your account is terminated for cause, we reserve the right to retain moderation logs related to the violations.
To the maximum extent permitted by applicable law, BenchMark'd and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
BenchMark'd is a free, non-commercial platform. Our total liability to you for any claim arising from the Service is limited to the amount you have paid us (which is zero, since the Service is free).
You agree to indemnify and hold harmless BenchMark'd and its operator from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from:
If you have a dispute with us regarding the Service, we encourage you to contact us first to attempt an informal resolution. Most concerns can be resolved through direct communication.
If informal resolution fails, any disputes arising under these Terms shall be governed by the laws of the jurisdiction in which the operator resides, without regard to conflict-of-law provisions. You agree to submit to the personal jurisdiction of the courts located in that jurisdiction.
We may revise these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. For significant changes, we may notify registered users via an in-app notification.
Your continued use of the Service after revised Terms are posted constitutes your acceptance of the changes. If you do not agree with the revised Terms, you should stop using the Service and delete your account.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, or if that is not possible, it will be severed. The remaining provisions will continue in full force and effect.
